Terms of Service

1. Agreement

These Terms of Service (“Terms”) form a legally binding agreement between you and Lead Skills, LLC (“Lead Skills, LLC,” “we,” “our,” or “us”), the operator of the website Hard Money Lenders Dewey Beach (the “Site”). By accessing the Site or submitting an inquiry through the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. Our Role: Lead Generation Service

The Site is a lead-generation service that connects borrowers seeking real estate financing with participating hard money lenders who may be able to provide that financing.

We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions — including whether to extend a loan offer, loan approval, pricing, underwriting, funding timelines, and all terms and conditions — are made solely by the participating lender that considers your inquiry. Participating lenders are independent third parties. Their services, programs, fees, and practices are their own; we do not control them, are not their agent, and do not receive or process loan applications on their behalf.

3. No Offer or Solicitation

Nothing on the Site constitutes an offer, solicitation, or commitment to lend, or a guarantee of any particular loan product, rate, term, or funding outcome. Content on the Site is informational only. Submitting your information does not guarantee that you will be matched with a lender, contacted by a lender, offered a loan, or funded. Availability and terms of any financing depend entirely on the participating lender and on borrower and property qualification by that lender.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a contract in your jurisdiction to use the Site or submit an inquiry. You agree to provide information that is true, accurate, current, and complete, and to update it if it changes. Providing false or misleading information may result in rejection of your inquiry and, where applicable, legal consequences.

5. Your Consent to Be Contacted

By checking the consent box and submitting an inquiry, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry.

You understand your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP to any text message or by calling 302-592-2076. To stop communications from a specific participating lender, please contact that lender directly.

6. Equal Opportunity

Hard Money Lenders Dewey Beach connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Submit information about another person without that person’s authorization;
• Interfere with or disrupt the Site, its security features, or its underlying infrastructure (including automated scraping, probing, or reverse engineering);
• Misrepresent your identity, affiliation, or qualifications;
• Transmit viruses, malware, or other harmful code;
• Use the Site to harvest information for spam or similar purposes.

8. Intellectual Property

All content on the Site — including text, graphics, logos, images, layout, and software — is owned by Lead Skills, LLC or its licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, or create derivative works from Site content except as expressly permitted by us in writing.

9. Third-Party Links and Services

The Site may contain links to, or rely on, third-party websites, services, or content (including participating lenders and service providers). We do not control third-party services and are not responsible for their content, policies, or practices. Your interactions with third parties, including participating lenders, are solely between you and the third party.

10. Disclaimers

THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the Site will be uninterrupted, secure, or error-free; that information on the Site is accurate or complete; or that any inquiry will result in a match with a participating lender or a loan offer on any particular terms.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY INTERACTIONS WITH PARTICIPATING LENDERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

12. Indemnification

You agree to indemnify, defend, and hold harmless Lead Skills, LLC and its affiliates, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to (a) your use of the Site, (b) your submission of any information to the Site, (c) your violation of these Terms, or (d) your violation of any rights of a third party.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the “Last updated” date above. If the changes are material, we will provide additional notice as appropriate. Your continued use of the Site after the changes take effect constitutes acceptance of the updated Terms.
